1. Agreement

By using this website or booking a session with Toby Hagan Photography, you agree to these terms. If you do not agree, please do not use this site or our services.

2. Booking & Payment

A session is considered confirmed only upon receipt of a signed contract and any required retainer. Specific payment terms, cancellation windows, and rescheduling policies are outlined in the client contract provided at booking.

Retainers are non-refundable unless the cancellation is initiated by Toby Hagan Photography.

3. Deliverables & Turnaround

Edited images are delivered digitally via an online gallery. Estimated turnaround times are provided at booking and may vary by session type and seasonal volume. Rush delivery may be available upon request for an additional fee.

4. Copyright & Usage Rights

All photographs created by Toby Hagan Photography remain the exclusive intellectual property of Toby Hagan Photography. Clients receive a personal-use license to print, share, and display images for non-commercial purposes.

Commercial use, resale, or licensing of images to third parties requires prior written permission and may involve additional licensing fees. Removal of watermarks or metadata without permission is prohibited.

5. Portfolio & Marketing Use

Toby Hagan Photography reserves the right to use session images for portfolio display, website use, social media, and print marketing unless the client requests otherwise in writing prior to the session. Identifying information will not be shared without consent.

6. Limitation of Liability

In the unlikely event of equipment failure, illness, or circumstances beyond our control, our liability is limited to a refund of amounts paid. We are not responsible for consequential or incidental damages. We recommend clients retain backup copies of all delivered images.

7. Website Content

All content on this website — including photographs, text, and design elements — is the property of Toby Hagan Photography and may not be reproduced, downloaded, or distributed without written permission.

8. Governing Law

These terms are governed by the laws of the Commonwealth of Virginia.
